The first step in dividing property is classification. Property must first be classified as either community property or separate property. In California, property acquired during marriage and prior to separation is presumed to be community property. This presumption may be rebutted if it can be shown that the property is otherwise separate property. Separate property is generally property acquired prior to marriage, after separation, or during marriage by gift or inheritance.
